Townhome Neighbor Will Not Help Equally In Maintenance (dictated By Party-wall Agreement)
My neighbor and I have a party wall agreement which outlines shared responsibility for maintaining the exterior elements of our matching townhomes (foundation, walls, roof, siding, trim, stairs, snow removal), as well as the common space (lawn, trees, landscaping, snow removal) we co-own.
Over the years, she has refused to pay for any maintenance on "my side" including foundation leak, install of french drain after leak, new heat tapes after a roof replacement, hornet infestation of soffits. To keep peace, I've paid for many of these things.
Most recently, she is refusing to share in mulching, because "I installed the landscaping after installing the french drain". That project cost $20K, and her refusal to pay for the $200 in mulch was my breaking point.
How can I keep the property maintained without having to pay for all of this myself? Are there ways I can compel her to participate in maintenance?
For additional context, she "claims" she is a fixed income senior, but recently bought a new luxury car.
