Tenant Wants To Break Rental Lease Agreement, What Is The Proper Procedure To Go About This (texas)?
Location: Houston, Texas
My aunt had a tenant who was great, renewed their lease in September for 6 months, but now is leaving to go to another city due to job relocation and let us know less than 48 hours.
It consist of 3 people (two listed on the contract, one is not). The one not listed wants to stay there and continue to pay the rent.
We are trying to figure out the right way to go about this, because after many, many suggestions, we have heard different answers regarding the deposits, the lease, and handling the situation. We have heard drastic things to do, and even subletting, to minor things like transfer the lease, so just wanted to get the absolute best way to handle this to cover my aunt, so she can sleep easy at night (she is a senior so I am trying my best to give her the best advice).
Here is the contract (personal information has been redacted):
- Based on this, is the best situation to go on e-forms and create a early termination template contract stating the tenant is breaking the lease?
- Give the tenant notice that even though they are moving out, they are still responsible for the terms of the contract and rent until she finds a new tenant?
- Relist the property on Zillow and tell the other occupant they can re-apply and will be subject to a deposit, background check, credit check, etc?
- DEPOSITS. This is the most polarizing question I have. I have heard people tell us she the tenant is not eligible for a deposit for breaking the lease early, other people say he can get it back. I wanted to know for sure is the tenant able, or not able to get their deposit back (assuming they return the home back to satisfactory condition) even though they are breaking the lease early? I could not really find a definite answer in the contract above, just to apply "governing law".
