Sued For A Car Accident - What To Do

Card image cap

says it in the title - not sure if i’m doing the right things/taking the right steps here.

a little background - accident took place two years ago this june so we are just on the line of the statute of limitations. i was making a left across two lanes of traffic, thought i was clear but they hit me right at the back of my rear passenger door. speed limit on the road was 25 so i assume that’s about how fast they were going, i couldn’t have been doing more then 10 myself. i didn’t admit fault at the scene though it get deemed to be my fault by insurance, i didn’t even really speak to the other driver. they were walking around, talking and laughing with the police, denied medical attention, their partner came to get them and they left.

i didn’t get any citations or tickets from the accident. i have full coverage insurance, so everything should’ve been paid out. i thought i’d heard the end of it until i received the suit in the mail where she lists about two whole pages of injuries ranging from concussion to sprains to long term effects from the accident. she’s asking for “above the limit of arbitration” for our county, which is a 50k cap.

upon receiving it yesterday i called the insurance and got the right email address from them and sent it off. it was after their business hours and as of 10:30am this morning i haven’t heard anything.

is there anything else i need to be doing? the paperwork said i had 20 days to respond - will the insurance do that on my behalf? will they contact me to confirm they’re taking the case? should i hire my own personal attorney too? i feel like im lost here.

any and all advice is appreciated - thanks in advance!
