Receiving Child Support Not Owed To Us

Card image cap

Mississippi resident:

I adopted my wife’s son last year. His biological father still had custody and a child support court order in place. He hasn’t seen the child in 9 years so I was able to have his parental rights terminated and my adoption in one go.

A year later we are still receiving child support from him. He knows of the adoption because the guardian ad litem made contact with him and his mother (child’s grandmother) and won’t return our calls (not sure if we even have his current number).

Q1: What responsibility do we have to stop this child support? Currently it’s untouched in the Mississippi agencies account they initially provided with a card we could use to withdraw.

Q2: would we have to pay this back when he finally gets around to it 3 years later?

Thank you for your time!
