Private Dog Park Left Gate Open, Dog Died

Hello.

I belong to a private, member-based dog park. The dog park is staffed anytime the park is open and I had a monthly membership. You are required to check in upon arrival and abide by the park rules. Staff patrol the park area to ensure a clean and safe environment. The facility advertises itself as a safe alternative to traditional dog parks, as those can be a gamble.

The facility has posted rules that required that upon exiting, dogs only be leashed in the “secure vestibule” and not anywhere else, which is a double-gated space at the entrance/exit. The exterior gate was left open, causing my dog to run out as I entered the “secure vestibule”. Sadly, she was hit by a car and died a few minutes after. I learned later that night that another dog had escaped as a result of the same gate being left open 3 days prior to my dog’s death. In the first incident, staff said the wind must have opened the gate. Despite this, no added security measures were taken to improve the gate safety, no communications went out to members regarding the incident, and 3 days later staff again failed to ensure the gate was shut, and my dog died. Again, the rules stated that dogs could only be leashed in the “secure vestibule” and not the play area.

I realize that damages for a dog’s death are rare, but was there an element of negligence here? Thank you.
