Photo Posted Without Consent

I’m a high school teacher in MD. One of my students (17) came to me for advice because a picture of her (that she took & posted on her social media) was posted on a Tik Tok by someone else with a very obscene & salacious caption. She and many friends have reported the video to Tik Tok but they said it did not violate their community standards and would not remove it. She is, rightfully so, freaking out because she is going to college next year and is concerned about how she is being portrayed. Does she have any legal discourse to sue/threaten to sue to get it taken down? She does not know the poster personally (a friend of a friend just happened to see it and recognize her). From their profile she was able to figure out she lives in NY. The posters Tik Tok is a mixture of videos of themself and videos/pictures of other people that are obscene/salacious, similar to the one of my student.

Side note: I teach government and we recently covered the first amendment & defamation, so I’ve gotta say, I’m proud of her for making the connection but I’m more proud that she’s advocating for herself.
