Old Business Partner Is Contacting My Clients - Qc Canada

Card image cap

Location: QC Canada

I used to have an equal share in a business with a former colleague.

Due to us simply not liking each other, I bought his half of the company. He signed a contract saying he would not contact our clients.

He created a new business with a similar name and began soliciting some of the clients he had brought on when he owned half the company for reviews for his new company. We know he is doing this because the clients are telling us and because we found our clients reviews on his businesses similarly named review page.

Even if he is innocently trying to get reviews for his new company (which we doubt), this creates major problems for us.

The result of calling those clients, whether intentional or not will now leave his similarly named company's phone number as the most recent (our industry looking) phone number in their call history, so when clients attempt to call us, they will accidentally call him, which he will use to claim he has not violated the non compete because the clients are specifically reaching out to him instead of us. We believe it's malicious and the goal here is to setup a situation where he can intentionally intercept clients communications meant for our company.

We already sent a cease and desist.

He chose to not respond and is now contacting some my suppliers, clients, and contractors, some of which he has never done business with outside of my company, to claim I am unfairly targeting him.

We just want our contract enforced. What are our options here?
