My Job Retaliated Against Me For Requesting An Accommodation For My Disability By Refusing To Engage In Performance Discussions For Promotion, Uninviting Me From Travel That Everyone Else Was On, Making Me Redundant, Bullying/rude Behavior, & Eventually K

I know the million dollar question around a lot of retaliation litigation is: were you fired? My question is, what if I wasn’t technically fired, but I was kicked off my project?

Context: I am a consultant. I managed to get a role on a project with one of my company’s biggest clients. Two months in, I disclosed and asked for one simple accommodation. They put me through hell. They asked for a letter from my doc, which was expected. Then they needed another one with more detail. Then they wanted to have a phone call with her. Then they wanted her to fill out a five page in depth form. They had recently gave me increased responsibility, making me “owner” of many of my work stream’s activities. After disclosure, they started leaving me out of meetings, giving credit for my work to other people, and generally being assholes. They planned a really cool trip where the client, an entertainment company, took the team to a resort. They uninvited me from the trip. My boss refused to leave feedback in the tool for my talent discussion, effectively nuking my promotion. I was regularly yelled at in front of clients, ignored (telling everyone else hi when they join calls and excluding me), and humiliated. After a phone call with my boss discussing the drama, the next day she did a presentation on “how to work with someone who is too emotional” and then made me turn my notes into my own powerpoint, to drill in the point. My coworkers would order food for lunch, not include me, and eat it in my face. They made jokes about the fact that I had to leave a happy hour early to let me dog out (I had been in office all day and then we went straight to a team HH). All culminating in them telling me I’m being taken off the project, which, again, is highly coveted at the company, the very day after they eventually approved my accommodation. I technically still have a job, but I’m on the bench when I didn’t plan to be which is making my chargability % tank and further decreasing my chance of promotion. I also have to network and cold call to find my own next project. If I’m on the bench too long, they will fire me. Happened to my work bestie last year.

I’m reporting this all as retaliation right now, but let’s skip to the chase—do I have a legal case or will this be “handled” internally?
