My Father’s Business Help Take Loans Out For His Owner Operator And Now They Don’t Want To Work And Want To Leave All The Debt To Him.

Hello I’m really looking for help as my father runs a trucking business since 2016. He started off by himself as an owner operator and ran the company himself for a couple years until some of his friends ask if they could run under his MC authority. My father agreed and my dad’s business began to slowly grow to like 10 truck drivers I think and then to 20 in one year. My father took out equipment loans and different financing leases for some of the people who wanted work. My dad took out like 5 year loans and my dad and the driver came to an agreement that the driver will payoff the loan as they work. But now that the industry is not doing well and some poor business decisions by my dad made it difficult to find work to do. Now the owner operators want to leave and leave the remaining loan to my dad. My dad only took the loan out because he assumed that they will pay him back as they work and thought the trucking industry was in good shape for them to pay it all back. I know it’s one thing if they took the trucks and not paid but if they leave the trucks and don’t paid is there any way we could sue them? We do have contracts that were made but I don’t think this particular situation is in the contract. Some important facts that may help but I didn’t know when to write it in to the story.

  1. All the drivers are owner operators (independent contractors).

  2. All the drivers that my dad took a loan out for have a lease-purchase agreement signed.

  3. My dad doesn’t want the trucks if the drivers decide to leave them.

  4. My dad is an immigrant and English is not his first language so me being a college student still can’t really help him with all the legal stuff.

  5. My dad has a few promissory notes sign by the driver agree they will pay (that was the closest thing I could find to a contract that might help my dad)?
