My Ex Punched Me In The Face, I Called The Cops For Help And They Arrested Me Instead

This has been the worst day of my life. I got engaged two days ago. The next day, I found out I was being cheated on. I went to his place at his invitation to get the ring back (it was my grandmother's) and to try to save my relationship.

My ex-fiance said some very cruel things to me - basically projecting everything he had done back onto me. I wrote a sweet romantic poem for him earlier this week, and after what he said I didn't want him to have it anymore. I took the sheet of paper, tore it up, and threw the pieces in his lap. This made him jump up, punch me in the face, and threw me against the wall. I grabbed my phone and ran outside and called the police.

When the police came, they took statements from both of us, and arrested me. They said I was the aggressor, because of the sheet of paper I tore up and threw in his lap. I never denied doing this, but he told them that I also spit on him. I never did that.

I live in California, and they said no matter whether anyone presses charges they have to arrest somebody in cases of domestic violence.

I know I shouldn't have thrown the paper in his lap, but I definitely didn't deserve to get punched in the face. I never spit on him. I have no history of domestic violence or any violence, but he does.

I have a court date for domestic battery. Will he be at the hearing? Is there any possibility that he will receive justice?

I'm angry, I've never been punched in the face before and certainly not by somebody I love. This is the worst day of my life. Two days ago I was engaged, this morning I got punched in the face, and then spent the rest of the day in jail.

Do I have any recourse to press charges against him? It is not fair that he punched me in the face and threw me against the wall, and yet I went to jail for tearing up a poem on a sheet of paper.

I want justice. Is there anything I can do, or do I need to just let it go?
