I Was Driving For Uber, Picked Up A Passenger, And Was Shot At Multiple Times In A Gang Related Drive By.

I was driving for Uber and picked up a passenger around 1:15am on Monday, November 18th in Jacksonville, Florida. About 5 minutes into my trip a car pulled up next to me while doing 55mph on the highway and opened fire on my car. Unbeknownst to me, the passenger I had picked up was an active gang member and was being hunted by a rival gang and they were attempting to murder him. Also unbeknownst to me, he used someone else’s account get the ride and also had multiple firearms with him in my vehicle, both of which I’m pretty sure are against Ubers policy.

My drivers side window was shattered and I have multiple cuts and pieces of glass in my arm. My car has at least 12 bullet holes in it and the radiator was hit so the car has both body damage and mechanical damage, it is currently not drivable. Ubers insurance is scheduled to pick it up to evaluate the entirety of the damage.

Uber has been extremely unhelpful, they say they have an open investigation but it could take weeks to resolve and I have heard nothing from their “investigators.” Ubers insurance policy carries a $2,500 comprehensive deductible that they are telling me that I am liable for. They also do not offer a rental car.

I have called a few personal injury attorneys and everyone I have talked to has told me that I basically don’t have a case because the people who shot at me got away and they do not have an insurance company to sue for the matter.

So basically I am going to be held responsible for the damages, even though I did nothing wrong, I did not cause the attack, the passenger Uber set me up with was knowingly being hunted and broke multiple Uber policies. Do I have any recourse here? Can Uber not be held responsible in any way? Am I really going to be solely responsible for the damages, loss of work and the trauma I have been caused?
