I Think My Employer Is Stealing Tips/tip Skimming
We have a particular system at this restaurant when it comes to doing our checkout reports. Per usual, we type in our tips and print out the report on upserve, and then staple our receipts to the checkout report. We are then given a square paper that has blanks requiring us to write out our CC tips, net sales, sales per guest average, and a tipout blank. The thing causing me concern is their tip-out method. Monday-Thursday we are required to tip out 2.5% to “the house” which other servers have brought to my attention is the owner himself. Friday-Sunday we are required to tip out 4.5%. 2.5% to the house, 1.5% to server assistant, .5% to Sommelier . HOWEVER; this 2.5 or 4.5% is not coming out of my tip number. It is coming out of my net SALES. Which basically in my head, is penalizing servers for the more sales they make the restaurant. So if I sell $1700 worth of drinks/food on a Friday , and make an exact tip average of 20%, I make $340. Then I’m turning around and giving $42.50 directly to the owner, $25.50 to the Server assistant , and $8.50 to the Somm. I’m then left with $263.50. I’m down $76.50 for literally what???? Our Somm is on salary so why the fuck is he receiving tipout, and money shouldn’t be going back into the restaurant to directly to the owner from MY hard earned money. I’m happy to tip out our Server assistant though as she is very hardworking and helpful.
This restaurant is highly adamant on this system, and I can’t help but feel taken advantage of. I have heard people complain about it and say they “think it’s illegal, but what are you gonna do?” I’m personally not okay with being stolen from and if this is the case, I have no respect for my managers/owner and have no drive to attend work after this point. I’m pissed. I’m a younger person with no legal knowledge and little money. Is there anything I can do to get my money?
