Gym Incident: Fractured Rib And Collapsed Lung

Card image cap

Hi,

Need some advice regarding an incident that occurred at my gym.

For context, I'm located in California. I've been going to this gym almost every day for the past 4 years or so. It's a really nice gym with a hefty membership fee. Recently they have been undergoing some renovations, and have been moving the machines around a lot in the space.

Long story short, I was playing a pickup game on the basketball court, and while chasing after a ball to save it from going out of bounds, I hit a ball shooting machine that was placed in the corner of the court. This machine is typically kept off the court in a secluded area, but due to the recent rearrangement and renovations, someone had left it on the court basically blocking off an entire corner and covering the padded wall. I did not register that the machine was there and did not know I was taking a huge risk chasing after the ball. The impact resulted in me having a broken rib and a collapsed lung. I had to spend a day in the hospital on oxygen, and have since become very depressed due to my deteriorating health. I wasn't able to sleep for the best part of 2 weeks, and I've been out of the gym for a few months now and have gained a lot of weight. I had to miss a whole ski season and not go to altitude due to my punctured lung, etc...

I reached out to the gym informing them of this mishap, and they referred me to their insurance provider to follow up with my request. After a call with the insurance rep, he basically told me to look online for a typical settlement for a broken rib, and he said that I could expect such a payout.

I am not very legally savvy and have no idea how to move forward with making any sort of claim, much less, what I can claim for this type of injury. The insurance rep asked me to email him a detailed list of expenses incurred during the injury, along with a desired compensation amount reflecting the extent of disability resulting from the incident.

I'm wondering if this is standard procedure for an insurance company, and if so, what would constitute a reasonable compensation request and any advice with the process.

Thank you for your help!
