Employer Cutting Off Extra Hour And Asking For Me To Pay For Material

Location: Pennsylvania, right outside Philadelphia area.

I work part-time at a vinyl wrap shop. $16/hr, 34hr work week average, biweekly pay around $870.

I am the only employee at this shop.

Long story short, we had a client come in for a “re-order of vehicle graphics.” In order of events:

  • I took pictures and talked with the client, drew up estimate, including the year we’re redoing the graphics from

  • Reviewed with my employer/the owner

  • Sent client estimate via email

  • Client paid with a check

  • I started the design file with those graphics. I told the owner to review. She prints the graphics

  • I asked the owner when we could schedule him since he asked. Owner gave me dates. We schedule him.

  • Install comes and goes. Client comes to pick up. He inspects the car for a bit, comes inside, and pays with a check. He then leaves

  • Client calls two minutes later. He asks why his graphics don’t look like the truck we did four years ago. I am confused. Client send pictures to compare both trucks. There are slight differences. I grabbed graphics from the most recent invoice, while he wanted graphics from a much older job.

  • Owner blames me. Owner tells me I need to remove graphics on my own time. She tells me I will be paying out of pocket for the replacement graphics.

  • I stay clocked in while removing the wrong graphics for about an hour.

Today I came in and was told that the hour from yesterday is getting removed by editing my time in the app with a note. I am also still expected to pay the new material in full. I have asked if I can make up that pay with off the clock hours, and I got an “I guess so.” She has yet to inform me how much I owe.

Some questions:

1- Is this wage theft?

2- What actions can I take?

3- Should I take any actions while still employed?

4- How to find a lawyer if needed
