Brother Is A Grade School Teacher And Is Being Pressured To Resign In 24 Hrs Or Else He’ll Be Fired. What Can He Do?

This is in WV, a right to work state, but he is in the union. His principal (who started 2 years ago) gave him bad reviews last year and put him on a performance improvement plan for this year. My brother filed a grievance on the improvement plan, stating it was uncalled for, bc his test scores were good and he had no issues with parents, other teachers/staff, or anyone else but her. The grievance has been kicked down the road on the county end and has not gone much of anywhere despite how much time has passed. There’s been a lot of drama over the past year or so between the principal and my brother in that she’s always in his class, has been calling his students to her office to ask about them about him, calling parents to talk about him, etc. My bro’s union rep has been at many meetings between them and has stated that he’s never seen a case like his. Typically, teachers put on these plans more or less deserve them in his decades of experience—they’re phoning it in or screwing up majorly in some way—whereas my brother has always gotten good reviews/observations from the previous principal and all other observers and has always had good test scores and good feedback from parents (thus filing the grievance). The only ‘evidence’ pointing towards him as a bad teacher who needs to be removed is her subjective observations. Her Asst. Principal now gives him bad reviews but under the old principal who liked him (and will be writing a recommendation for him) she gave him good reviews.

My brother has since filed two other grievances over her behavior, but the first one, filed over a year ago, has not been seen through and the county seems to be stalling on it to now the end of the year (past when he’d be terminated or have to resign). No third-party observers have come in to assess my brother or his teaching. My aunt, who worked at another county’s BOE (retired), cannot believe that no one from the county has ever been sent in to observe and de-escalate this situation between a principal and a teacher. My aunt’s neighbor who was a lifelong principal and still subs (in another county) also was shocked at the county’s behavior on this.

Long story short, the county rep met with him Monday saying he needs to resign or else he’ll be fired as he’s failed her improvement plan. They told him this improvement plan and the bad reviews will all go away if he just resigns. He tried calling to follow up and ultimately emailed yesterday (Thursday) asking to get the terms of his resignation as well as a deadline and got a response from the rep saying he’s been given enough time to consider and needs to decide by 4pm today (and there will be no terms). On Monday the county rep gave no deadline and seemed sympathetic to his case as by all objective metrics my brother’s a good teacher, and WV is in a teacher shortage, so the tone change was unexpected and this all seems very unprofessional. He is being terminated based solely on the opinion of one person who serves as judge, jury, and executioner despite prolific explicit evidence supporting that my brother is doing everything he’s supposed to be doing in the classroom. (I’ve tried to keep this short so have left out a lot of the details and evidence that he has against her claims/how spurious her allegations are but his case seems to be a layup assuming he has any rights here.)

The union rep hasn’t done much besides encourage him to file grievances and lament how nuts a situation this is and how he hasn’t seen anything like this before. They’ve assured that if he gets fired that he’ll have attorney backing but I find it weird that this hasn’t been escalated beyond his rep if this is such an unprecedented situation. I also find it crazy that the county hasn’t attempted to get involved in the slightest. They’ve stalled on his grievances, have displayed any interest in investigating this situation (which is their job to my understanding) and are now saying he has to resign in 24 hours or else be terminated? It all seems so sketchy to me but idk if he has any rights. What recourse does my brother have or does he have any? TIA.
