Alabama Hit-and-run - Do We Press Charges?

We were victims of a hit and run. We, along with a witness, got the tag number, and the police found the driver and added his info to the crash report. There were no injuries, and we're filing a claim against the other driver's insurance to cover the damages. My question is about the driver's penalties. Hit and run without injury is a misdemeanor in AL. The witness noted that he had been following the other driver for some time and noticed him swerving. Considering he had insurance, we think the reason he left the scene was because he was impaired. Given our suspicion of drunk driving, we want the strictest penalties possible. Is that something we have control over at all? We signed a statement at the scene that we would press charges for the hit and run if the driver was caught. Is that all we can do?
