A Fellow Employee Showed Up To Work Drunk, They Didn’t Take Her Keys And As She Left She Hit My Car

Location: Charlotte, NC

The situation played out like this An employee where I work arrived to work drunk. This employee is having very tough personal problems, and upon the management discovering she was drunk, they confirmed by smell and immediately sent her home. They offered to call her an uber, or have someone pick her up. It was agreed that she would be allowed to sit in her car and wait, thus they did NOT take her keys. Well as soon as management walked away two different employees observed her start her car and peel out, she scraped up my front end of my 2024 Buick Encore and also messed up/rashed my rims. The observing employees then chased her car and banged on the windows shouting for her to stop. They did not call 911. My manager then came up to me and informed me of the damage to my car. I went out and looked and while this damage is not horrendous, it’s still damage and I’ll need to get my new car fixed. Another manager is reaching out to her once she hopefully gets safely home, and getting her insurance information. It’s required for her to have insurance in NC, so that is promising. However, it feels like I’m now relying on someone to be reasonable when they’re clearly unreasonable. Obviously the managers are also being reasonable, but are somewhat pressuring me into not calling the police and sending them to her house- as clearly they screwed up by not taking her keys, and the other employees by not calling the police. It’s been suggested that I should do an online accident report, and wait until tomorrow to see if she provides insurance information.

Legally speaking, what should I do? Apologies for formatting, I am on mobile as I’m still at work.

ETA: this is an establishment with a liquor license, even though she was not drinking here.
