9yo Assaulted By 14yo W/ Down Syndrome

What can I do? My 9 year old daughter was grabbed and punched in the back several times in the back by a 14 year old boy with Down syndrome. She was at school on recess lunch with all the 3rd graders like a normal school day. When, a 6th grader which is the 14 year old boy with Down syndrome (which I disagree even being still at a elementary school regardless of being in special education ) was allowed to play out with the third graders unsupervised which is when he commited the assault on my daughter. There was a janitor and another employee that was supposed to be watching the playground but they were at a wall sitting and talking to each other..which is crazy to think they made a janitor watch the children. Coincidentally, my wife stopped by for lunch at my daughters school when she came crying into the front office that she was attacked by the boy and no one knew. The principal and some other staff reviewed the camera footage that indeed she was attacked by the boy. And, after we took my daughter to the hospital to get checked she had no bruising but had soreness and pain. What can I do about this? I feel like the school was liable letting this happen! Also, my daughter is scared to go to school and running into the boy. Should I get a consultation with an attorney or something? p.S. this boy is known to be inappropriate as in masturbating in class and touching people etc. He should NOT be in elementary school let a lot alone with 3rd graders! What should I do?
