[tx] If Proceeding A Divorce I Move Out Can My Husband Claim Abandonment And Get Full Custody?

There is no physical abuse, but the mental and emotional anguish of my life is rampant. We have tried counseling and talked about a healing separation to try and get us both to a place where we can be present and healthy in our relationship.

After years and years of chance after chance, I'm tired of waiting it out for him to mature enough to be the kind of partner I need and so I'm leaving.

I don't want to furiously disrupt the home, so I plan to move out to a nearby community and then continue with filing for the divorce.

If I move out can he claim I abandoned my kids and file for full custody? I can't find any information about this.
