Wisconsin Divorce Marital Home Question

Location: Dane County, Wisconsin Going through divorce from emotionally abusive spouse. We signed and submitted to the court a final settlement agreement wherein in I stay in the home and pay him a buy-out.

Divorce won’t be finalized until end of December, spouse is moving out by end of November. Spouse has stated he will continue to come into the house to visit the pets (he is not keeping any of them) and sometimes sleep in the house (the only available bed is the one I sleep in) after fully moving out until the divorce is finalized.

Does he have the legal right to continued access to the home after he has moved out since the divorce is not finalized yet even after it is not his legal place of residence?

Note: There are no police reports or other legal documents confirming abuse, only personal documentation and a couple witnesses (he’s savvy enough to toe the legal line) so getting a court order to keep him out would be a major challenge.
