Who Is Ultimately Responsible To Fix The Dryer? Landlord Or Tenants?
Location: Texas
Context: It is a single family home with a private owner. Three tenants. It’s a generally informal arrangement, with the landlord living in a tiny home on the back corner of the half acre property. We share the washer and dryer in question with the landlord in the main house and don’t have any issues with that.
The heating element in our dryer stopped working. I re-read the lease, and it originally stated that:
“Landlord will be responsible for, and will pay for, repairing (and restoring to working condition) the appliances, fixtures, or equipment located in the Property, except if any repairs are necessary as a result of improper use by Occupants, or the guest of any Occupant.”
However there was an Rules Addendum with one of the rules being:
“Washer, dryer, and refrigerator are all owned by home owner. These are loaned to the renters. Should they break the renters are responsible for fixing and/or replacement.”
Does one statement overrule the other? What are my best options?
