Trial For The Death Of My Sister In 2015 Landed A Hung Jury 2 Times & Was Thrown Out The 3rd
Location: Livingston Montana
Background
In December of 2015 my sister was killed in a single vehicle accident outside of Livingston Montana. Long story short, the trials ended in 2 hung jury's and the final case was dismissed to never be tried again. Come to find out a few things over the years.
The prosecutor for the case had a previous relationship with the defendants attorney. I do not believe this was disclosed, and if it was during the trial we would of requested someone else.
I'm not going to comment much more on that because it's there, nothing really more to be said about that.
Now for the crazy.
From the beginning something was just NOT right.
When the accident happened there was 5 people in the vehicle. 3 males, my sister, and her female friend. Everyone in the vehicle was drunk. My sister, from statements made, was not conscious and was practically dragged into the truck. (This doesn't really matter but I felt like I had to say it anyway).
The accident happened, people were pretty banged up, there were 2 ejections from the vehicle. The defendant, and my sister. The defendant survived, obviously, my sister did not. Everyone else lived, my sister was the only fatality.
The issue arises when the wrecker crew, to retrieve the wreck is called into the mix. I find out all the information shortly after but I learn that the state allowed the father of one of the male subjects in the car, who also happens to be close friends with the defendant, to take the vehicle and bring it back to the wrecking yard where he worked.
I feel like I'm rambling a bit but there is just so much information and it's hard to write it all down but I'll try to simplify what I said.
The defendant, was friends with the 2 other males in the truck.
One of the males in the trucks father worked for a wrecker company.
that wrecker company is the one who took the truck back to there lot.
The reason this all matters is because the defendant, in trial, landed a hung jury twice because they argued that it could no be proven the defendant was driving the vehicle. With the vehicle not being in the proper chain of custody, and in the lot where the father of one of the defendants friends had access to the vehicle which leads me to believe that the state did not properly maintain evidence.
Either way, that's not even the end to the mess.
On the last trial, after battling with hung jury after hung jury, spanning years. We are left with the final nail in the coffin. It comes out that the state threw away key evidence for the trial. Which in turn ends with the judge ruling basically we can no longer try this case again.
I'm sorry if this is all over the place, if someone asks questions I might be able explain or give some sort of context or something. There's just sooooo much to this and it's hard to think of everything to write down.
My question to everyone if it's even something anyone would possibly know. What, if anything, can I do to go after the state for how poorly they did there job? Is it too late now? Any insight would be nice.
EDIT: I don't really know what legal standing there is if anything so wanted to get any kind of answer. If anything, I appreciate everyone weighing in. I understand now to some degree.
If anything, I guess I've brought this whole situation into the light once again.
I feel the best thing I can do in this situation is try to work in the future to make sure something like this doesn't happen again. Thank you all for taking the time to look into it.
