Sister Got Suspended For Walking To Class During The Pledge Of Allegiance.

Yesterday my sister got stopped and scolded for walking during the pledge(she was going to be late to class if she just stood in the hallway for a minute). She informed that administrator that she does not have to do anything for the pledge of allegiance as it violates her first amendment rights.

Today she did the same thing and an administrator sent her to ISS(In school suspension) and she got suspended for it for 3 days. Is there anything legal that can be done?

I graduated from this school a year ago and I NEVER stood for the pledge. I got so many glares. Whatever! But never was I harassed and suspended over it. Also this is a public school in Southern Georgia.

Students who opt out of the pledge may not disrupt the pledge as others say it. Public school students may be punished if they disrupt school or interfere with others’ rights. Talking, making noises, engaging in distracting behavior or just generally being rude and offensive while others are saying the pledge could be punished.

This is the only information I could find pertaining to the pledge and being punished for it. My sister was doing none of that. She was simply walking to her first period class as the intercom was saying the pledge. Possibly rude but what’s rude about not wanting to be late to class..?

UPDATE: We picked her up and got the official suspension paper. She was suspended for- Incident Details: Two mornings in a row [NAME] has not stopped during the Moment of Silence. Yesterday on 4/24, she was redirected by an administrator that she needs to pause during the Moment of Silence. Today, 4/25, she was walking through the Moment of Silence again and was prompted by multiple admin to stop but she did not.

She now is suspended until the 29th and has ISS 2 days when she comes back. The moment of silence is during the first period bell. Over 200 students are still outside their classrooms during the moment of silence. It makes no sense to stand in the front of school for 40 seconds to then be late and walk through a sea of students. this is insane.

Thank you everyone for your opinions and suggestions. This is a difficult situation and I’m glad to have gotten some insight.
