Property Dispute With Neighbor

In NC. me and the mrs. bought a house recently with a fully fenced in backyard. we noticed during the final walkthrough one of our neighbors had a sign up that said part of our fence was on his property. before we signed anything we got in contact with the sellers lawyer and they assured us that he was wrong and provided us with a survey (1 year old) proving that we were inside our boundary. the neighbor is refusing to let it go and the fence just started magically getting damaged. multiple cuts too precise to be weathering. we couldn’t prove it was him but we set up cameras on the fence line and the damage stopped. but now he has erected a birdhouse that’s leaning like 2 feet over our fence into our yard. we want it gone, and i’ve asked him to move it and he doesn’t respond. i’ve thought about just cutting it and placing it on his front yard but he appears a little bit unhinged. (we’ve seen him pacing in his backyard with a pistol in his hands) so we were thinking of taking the legal route to avoid any crazy situations. i was just looking for advice on what to do in this situation. any help is appreciated and thank you for your time.
