My Sister Passed Away, My Mother Wants Guardianship, Abuse Situation

I live in North Carolina, My sister who was only 27 passed away January 23rd, 2024 leaving behind her two children three & six. She had a live in boyfriend, who he presume is the father but he was never added to the birth certificate. She was also still married to another man when her oldest child the six year old was born. After she passed I got her phone, and was looking through some things and came across some information of abuse, to her and the kids, and abuse that happened in front of the kids. He began changing all of her passwords to her emails, her Facebook accounts, and started packing up my sisters belongings. When we confronted him about him changing her passwords and packing up her belongings he became very angry, cussing, and even grabbed my mom/jerked items from her hand The day after she passed. He ended up leaving, taking his stuff, and some of hers, but left behind the children with my mother. He began riding by my mother’s house, watching us, and following me to my house as well. After he left the six year old began telling us, and his teachers of the abuse, his school reported it to CPS, and they opened up a case against him. We also had a court date for a protection order, Which we won,and he can not have any contact with my mother or the children for a year. CPS put the children in my mother’s care for the time being but today she was served with papers that he is wanting to establish paternity, and have their birth certificates amended. What can we do at this point? The children are also in school here and therapy in NC, he quit his job and moved to SC in with his mother. We have no idea where to go from here or what to do.

We also believe that he may have done something to her the night she died, we have turned over all the abuse, and evidence that we have found to the police. She was 27 and died from an aneurysm, after she passed his mother wrote a to do list for him to do that seems very fishy..
