My Brother (23) And I (24m) Inherited Our Moms House. He Withdrew $165000 From His Ira. Am I Going To Lose The House? (ca)
My mother died back in 2019 leaving my brother and I our childhood home, a trust, and beneficiary IRA accounts. We don’t gain control of the property until we reach the age of 30.
Over the past year my brother has moved out to live at his girlfriends house, because he started to be extremely hostile at our shared property towards me, my girlfriend, and our roommates. For context he has vandalized the house; broken windows, broken sliding glass door, threatened to kill my partner etc. All due to excessive substance and alcohol abuse.
During that year span of continual vandalizing and abuse he took out all $170000 from his Bene. IRA (which you have to pay income tax on) He has currently not paid his taxes from 2022 as well as 2023 (having the large $170000 distribution).
I guess my questions are.
Am I going to lose my house?
Is it possible to have a party removed from a trust due to mistreatment of the property or extreme negligence?
