Living Trust & Will & Elective Share
LOCATION NYC
Hi so I’m in a situation where I want to leave everything to my son and not my wife because of disagreement that I will not go into here.
Right now I have a house, car, bonds, joint accounts with my wife. My wife has not contributed to any of the above no names on deeds, besides having money in our joint account.
Currently NYC has spousal elective share, so how would that affect my situation say if I leave only the money in the joint account to my wife and the house car bonds etc to my son.
Can she fight that that? Would creating a living trust help? If not I s there a way to do it?
