Legal Separation And Buying A Home In California

Card image cap

Hi, F[45] got married to a M[55], our marriage is 2years old which hasn't stabilized yet due to huge differences and red flags we didn't see it coming. I keep traveling for work most of the times and makes more money than him. We both agreed to buy a home before marriage since buying a house was my THE ultimate goal. It's been a dream and I was waiting for years n years to come. SO knows this since I made this very clear to him right since the beginning. I even have some savings done for that. He had agreed upon to goal at the time of marriage. He is now not budging to even make a move from his current place to a different place within the same state while I have moved 3 addresses so far in 2 years going back and forth to my state where I was living before marriage, this was all due to our differences and fights and a third woman involved and also for my work. He is very very abusive and always have verbal attacks at the slightest critism. I also see He has Narcissistic traits.

During one of the fights recently he told me to show the guts to buy a home on my own and he will also do this on his own in future. I want to really go ahead and do it now since this was my dream and always wanted a to settle down having a family. I told him since we are not getting along let's just separate. He always never gives importance to this and never initiate for divorce. The divorce threatenings has come many times from him during the fights but doesn't actually act upon it.

I'm tired now since I see houses that are affordable and we really end up fighting.

We don't own anything as community property. We have our separate property owned before marriage. No Kids, Do not have joint bank accounts, we were renting, we both were literally on our own except only contributing for vacations.

Anybody out there who got legal separation in California please help out as much information as possible ????

I want to know - 1. What will be the legal implications getting a legal separation in California? 2. If I go ahead and buy a home will he be entitled to it if we are legally separated? He's thinking I might buy now with my own money and he would be entitled to the equity building on that house even though he will not be contributing any dime on the mortgage. 3. Do I get a lawyer or Paralegal would help?

Appreciate your time reading to the post and commenting!!!
