Illinois—getting Evicted For Smoking

Hi folks,

I’m getting evicted for lease violation: got caught smoking in my apartment twice over the past year.

I learned that I’m going to receive a ten-day notice to vacate the apartment. The property manager said that the owner is likely going to take me to court.

I suppose the court process is to obtain a warrant for my removal by the police. However, if I vacated the apartment within ten days, can the owner still take me to court? I suppose he can’t. But if he can, what would it be for?

My concern is I don’t want to get a public record for eviction.
