Hoa Wants A Say In Who You Sell Property To

Hi all! This is a throw-away account i made just for this post. So i 23(f) live with my mom 61(f), and her home is in an HOA in MO. All names are fake in the post.

At the most recent HOA meeting a new(ish) neighbour we will call Ted, tried to put forward a new rule that if someone is trying to sell their property the seller MUST try to offer the property to the other HOA members before trying to sell it to an outside potential buyer. They also are trying to put forward that the HOA members should have a say in who the property owner sells to.

Is this legal? My mom and some other neighbours voted no on the move.

Edit: i guess some helpful notes to add?

  • The community is about 7 houses and mostly retirees and parents with students in college, like my mother and I.

  • I have lived here all my life and the main purpose of the HOA had been to upkeep our gravel road and cut back trees or clear debris from the road.

  • we think this was brought up by Ted because my mother and some other members expressed wanting to sell their property (cheap) to their children since the prices of housing are super high.

  • the HOA itself is older than I am and my family had live there before i was born, along with other families
