Hoa Is Refusing To Help Fix The Foundation Of Our House, Even Though My Home Insurance Says It Should Be Under Their Jurisdiction

Hello everyone, my husband (m25) and I (f25) have owned our current townhome/condominium since November 2021. This is our first home we’ve owned so repairs are still pretty new to us despite doing our best to upkeep our home.

Recently due to the winter thawing and the many rainstorms during the last couple months, our foundation in the basement has shifted and water has been leaking into a specific area in the basement. This has caused major damage to my husband’s personal belongings, as well as the wall and carpet. Mold has started appearing as well and we’re doing what we can to keep it at bay, but even with 2 dehumidifiers it continues to worsen.

I contacted my home insurance first very soon after this started (beginning of April this year), and they said the home’s foundation is under our HOA’s jurisdiction. I then call and leave a couple voicemails and emails for our HOA to contact us, and after two weeks we finally get a reply where they state that it is not their responsibility and that we should contact insurance.

We spoke with our insurance again, and they are firm that it should be the HOA’s responsibility, and will be contacting them soon in order to hash out their disagreement. I wanted to post this to see if anyone knows if we have any legal backing on this? Does it vary from state to state, county to county? Where do I even begin?

TLDR: my condo’s foundation has shifted and has resulted in major damage from leaks over the past month and a half. Both my home insurance and HOA are pointing fingers at who’s responsible for the damage, and I’m wondering if there is a way I can legally hold my HOA accountable for the outside of my home deteriorating.
