Gf Being Taken To Small Claims Court Over Freelance Art.

Hi! I’ll try to summarize this the best i can. My gf is a freelance artist. About a year and a half ago she started talking to a regular customer of mine (we worked together at the time at the same retail store) about a children’s book this customer was writing. She exchanged info with my gf as she wanted her to be the illustrator for her book and my gf was ecstatic. Over the next few months they sent emails back and forth with updates and what not. The writer and my gf verbally agreed that the total pay would be $2000 paid in thirds. Basically she paid my gf a total of $1500 about half-way through her illustrations were complete.

My gf didn’t hear back from the customer until about three months later when she, out of nowhere sent my gf a long email basically saying that my gf was “taking too long” to complete the work and she decided to go with another artist. (They never set a deadline) However, the problem is she requested that my gf pay her back the $1500 she had already given her upon seeing halfway completion of the project. My gf tried to reason with her and see if she could speed up the process for her but she refused and then demanded the money back she had already paid her, again, even though my gf had already completed more than half of the project by this point.

That was about three months ago. Fast forward to two days ago. My gf gets served a civil warrant from the customer demanding the same $1500 that she had paid my gf for her work. She now has to attend general sessions later this month.

How do we go about this? Shes never been to court for anything before and legally speaking, we don’t believe the customer is entitled to the $1500. There has also never been a written contract made between the two of them. It has been all verbal since the beginning.
