Ex Filed Himself As The Defendant So He Could Get A Public Defender In Custody Case.

I live in Indiana.

Thursday, dcs showed up at my house. This is their third involvement. They found some problems they said they wanted fixed by Monday. It was a kid free weekend so it was a non issue. I asked them point blank if they were going to be telling the other parents the kids couldn't come back this time and they said no.

They came back Monday and said the house was good and to keep it up but they'll be back. The kids have all been back since this incident and the house is being kept clean. I'm not worried about that.

My ex, the father of two of my kids (8f and 9f), filed for a suspension of visitation and is requesting a hearing regarding my parental rights. The hearing is for May and I saw nothing regarding whether or not visitation was actually suspended so I'm assuming not. He filed himself as the defendant and me as the plaintiff and is requesting a public defender. We have been through this process enough times that he knows by now who the plaintiff and defendant are supposed to be, and he knows that only the defendant qualifies for a public defender.

I plan on taking these papers to the courthouse as soon as physically possible so I can inform them of the error. Based on conversations I've had with some others who have been in similar situations I'm told he may have royally screwed himself.

I have been complying with DCS and have been nothing but open and honest through this process. What else should I do?
