Does My Coworker Have A Case?

Card image cap

So I work overnights doing the front desk at a condo part time. We have 24/7 valet and I found out that the valet dude who works the same shifts as me works 56 hours a week but they only record 40 hours of pay for him on his stub and zelle him the hours over 40.

He makes 15$ an hour and they do NOT give him overtime pay so those 16 hours a week are just sent to him via Zelle at his regular rate, not time and a half. His manager says they don’t pay overtime, but I’m pretty sure as a non exempt employee you’re entitled to OT pay?

I told him to keep a record of his hours worked and consult with a lawyer but he doesn’t think the outcome will benefit the cost of a lawyer. Do you think he has a case if he were to sue his employer? This is in Florida btw
