Do I Have A Case To Sue For Hair Discrimination?
Location: Jacksonville, Fl Long post alert***
Hello, I’m seeking legal advice regarding what I believe may be wrongful termination and discrimination based on hair and cultural expression while employed as a Correctional Officer with the Florida Department of Corrections (FDC).
When I was first interviewed by the FDC recruiter, I specifically asked about the grooming policy because I am a Black man who wears braids and a semi-long beard. The recruiter told me that I would need to keep my beard trimmed to a quarter inch but that my braids were fine so long as they were clean, neat, and professional. Based on that assurance, I accepted the position.
During training, the Major held a meeting to review grooming standards and actually used me as an example, stating that as long as the issued DOC cap fit properly over my hair, it was compliant. Both the Warden and Assistant Warden also saw me several times during my employment and never mentioned any issue with my hair.
About five months later, I was suddenly told that my braids were “out of compliance.” I have only four braids straight back tied in a small bun. When I asked for clarification, they cited a part of the policy that says employees cannot have “patterns” in their hair — but that rule was written to apply to all correctional officers, not specifically to men. Despite that, the only people called in were Black male officers with braids or locs. They were told to cut their hair or face termination.
I explained that: • My hairstyle was approved by the recruiter and Major. • The “no pattern” rule was being selectively enforced. • Female officers with braids and locs were not disciplined or told to cut their hair.
They still gave me the choice to resign or be terminated. I refused to resign and was terminated. Several colleagues told me this situation was unfair and possibly discriminatory.
I’ve contacted a couple of law firms but haven’t been able to get help yet. I’d like to know: 1. Do I have grounds to pursue a wrongful termination or discrimination case under federal or Florida law? 2. Could this fall under Title VII of the Civil Rights Act, or under Florida’s CROWN Act protections (if applicable)? 3. What kind of attorney should I look for (employment discrimination, civil rights, etc.)? 4. What documentation or evidence should I gather to strengthen my case?
Any guidance on next steps, potential legal claims, or how to get proper representation would be greatly appreciated.
Thank you for your time and consideration.
