Divorce Attorney Ran Off With Retainer

(NYC) Hired a divorce attorney, let's call him David, who asked for $4500 to file and close a non-contentious divorce. It took him months to file the papers, he would answer the phone for weeks, wouldn't respond to emails. And the because of the way he filed the papers, the divorce quickly became contentious. I hired another lawyer. When I asked David to return the unused portion of my retainer, he refused, saying that it was a flat fee. Nowhere in our retainer agreement did it say that there was any flat fee, and his work was nowhere near the $4500 I paid. After tens of emails he responded by sending me a link to the NYCLA fee dispute resolution program. He refused to provide me with any fee materials, breakdowns, etc.I want to sue the guy for the entire sum - is this fee dispute resolution program enough, or are there other ways to get my money back?
