Can Someone Be Hit With A Pfs Over “death Threats”

I am posting this for my sister as she doesn’t have or know how to use reddit. This is a long one, and like the beginning of a Dateline episode.
Lifetime story short as possible, 3 members of our family are taking her to court for PFS’s.
Their claims: - They say she’s making hundreds of posts that she has guns and is going to shoot them. - That she is mentally ill to the extent of being a homicidal maniac (even claim her husband called and told them this) - They claim that she stated she’d slaughter them and all their children - That she created several accounts and incessantly contacted them to threaten their lives -That she stole and posted private family photos
Now, the family, who several years ago she distanced herself from, were abusive to her. They are bad people but have a lot of social, political and police pull in our area. Lots of money. She left the family for the most part 7 years ago but fully ~3 years ago. Lately, however, they’ve started getting into legal trouble for alleged white collar crime.
Here’s the true story of this. She is a small time influencer on TikTok. A lot of her content is lifestyle and education, and she also speaks on life during/after familial abuse. Typically, this is either comments such as “this is what happened to me during familial abuse and here’s how I process it” or something satirical like “you all know I win the mean mom contest!” However, 2 times she shared a news article about the family’s investigations.
In the span of about 5 years, she’s had maybe 6 points of contact with EVERYONE in this side of the family combined, that’s even including people not named in the filings. That’s texts, social media, anything. She never called them, never showed up at a home or places of business, never threatened them, never confronted them if she saw them in public. Not a single thing. They even admit most of that.
She retained a criminal defense attorney and a PI because she took the false reports seriously. They have scoured many witnesses, her social media, everything they can. They both state this is the most ridiculous PFS case they’ve ever worked. That she never did anything wrong, anything illegal and not even anything pushing a boundary of illegal. They’ve even called her boss for reference who stated she’s so solid that he’s planning on promoting her to a high responsibility managerial position (which she’s already started training for). The family added in screenshots of some of these “claims” that the lawyer actually chuckled at due to how incredulous they are. They don’t say what they claim they say. There’s literally nothing in their filings to back up what they’re saying.
Here’s why this is happening. One of the men in question is running for political office again since it’s election year, and he’s doing this because he doesn’t want anyone figuring out her TikToks include him. He verbally stated this to one of the witnesses, who will be testifying. She’s not THAT big of an influencer, you guys. Also, their white collar crime investigations are not going well for them, and other crimes they don’t want getting out.
The BIGGEST issue is the second man who filed against her violently sexually assaulted her best friend who was a minor at the time. She recently made a few side comments loosely eluding to her support of her unnamed friend. Also he verbally attacked her and was very scary towards her. She mentioned both these unnamed men physically intimidated her in person. Once this happened, she started getting their wrath. I’m sure they’ve had PIs follow her, they got her new address, made false police reports, etc. Now she’s in court fighting this.
She had the initial court date to contest, which they did, and one of them brought in her newest baby, cried and lied, making those same claims. So the judge (who doesn’t even know what TikTok is) sympathized with her. The temp orders were all put in place and the judge didn’t even review the (lack of) evidence.
She has truth on her side, as well as witnesses backing up her claims that she’s a good person, volunteered with children, at church, volunteered to rescue disabled cats, and is just a solid nice person with not so much of a parking ticket on her record. Y’all, they could scour her devices - she’s never said these things or even eluded to them. She’s is not and never has been like that.
To wrap this up, here are her questions:
- Do you think her general content talking about experiences could amount to harassment since the family technically knows it’s about what they did to her? Because it makes them uncomfortable knowing she is referencing them numerous times? None of it is threatening or nasty, but it’s a common theme in her advocacy/trauma recovery content.
- What legal recourse does she have about them making false police reports and false statements in courts? Both have been done. She would like to press charges if possible.
She seems to have a good lawyer but said she always appreciates the experiences of the masses.
