Can My Mil Sue?

A little over 6 years ago, my husband’s grandpa passed away leaving a sum of money to split up between his 3 kids as well as dividing the ownership of his grandpas house between them. Mind you, the house was bought in the 60s and is in dire need of renovations, especially after his uncle has neglected most of them. Since the death, his uncle has spent the money that was suppose to be split between them on god knows what and has let the house decay, only recently starting to make repairs this year. My husband and I have been trying to get his mom to go after her brother for the money he spent and his ownership of the house but she has yet to do it after she said she would get a lawyer many times. But today, he asked her to sign her part of the house over so that he can take a second mortgage out to do repairs on the house since it is completely falling apart. What are the realistic possibilities of her lawyering up to try and take his name off of the deed as well as getting him to cough up her share of the money. Is it possible to get him to sign it over legally in exchange for her share?
