Can Castle Doctrine Help Me?

Card image cap

Location: Tulsa, Oklahoma.

Charged with: assault w/a dangerous weapon.

Details: A man sent me threatening text messages making it clear he intends to physically attack me when he sees me and advising me to "be ready". I replied multiple times he is not welcome anywhere near my home and that he will be trespassing if he shows up, and that after being advised not to show up so many times, that his arrival at my residence will be considered an attempt to make good on his threats. He showed up anyway.

Before he was even out of his truck I told him he was trespassing and needs to leave immediately. He got out of his truck and said I'll leave when I'm ready. (Context: I had kicked my ex-girlfriend out of my house and he was there to help her load her belongings in a trailer. She was also clearly advised multiple times that he is not welcome here.)

He made another verbal threat in the driveway, telling me he would beat my ass right now if I did not have a wrench in my hand, (I was working on the lawn mower when he arrived) so I dropped the wrench and we began to fight. His ear got torn halfway off and he broke three of my ribs. He went back to his truck and called the police and said that I attacked him. The police took me to jail for assault with a dangerous weapon without looking at any of my security footage or text messages. They basically told me that since he was bleeding and they could not see any injuries on me, and that he was the 911 caller, that was the reason I was going to jail.

I'm shocked! Now I have a felony charge. I have every message that I mentioned here to show as evidence. I've already printed it off at the library. I've put copies of the surveillance camera clips on flash drives for the prosecutor to see. From what I have been reading it sounds like there is something called the castle doctrine that may merit the dismissal of this charge?

My question is - does that sound correct? I can PROVE that he was in the wrong all the way around, and also that I never used or wielded a weapon against him.

I have arraignment in the morning. I intend to get this charge dropped and press charges against him. I've already filed a police report against him this morning, but there was no way to attach the evidence online, so I have to go back tomorrow and hand it over. If you have any questions or need other specific details, wording of messages, whatever might be important, I don't really know for sure what to focus on but I have plenty of proof that he wasn't supposed to be there and was trespassing by arriving, making threats of violence while he was there, refused to leave when he was told. All of the incident took place on my property. I can't believe I got charged and taken to jail. I really can't. Let me know if you need any further information. Thanks for the chance to ask for help!
