Ca- Would Sole Custody Be Easier To Get?

I’ve been divorced for almost 7 years now. In that time span, the Non-Custodial Parent has seen the children a total of 10 days. He has continuously told me he doesn’t want anything to do with them and would like to finally be able to do things for his family he has now except he is $225k behind in child support. In our decree it mentions that if we want, we can get passports and the other parent has 7 days to respond and fill out the necessary paperwork. I emailed asking him to sign off but he continues to say he wants to work out a deal to forgive all his arrears and then he’ll sign. This has been an ongoing thing with him and I was wondering how hard it would be to file for sole custody of the kids. Would that affect the child support order? He’s been asking my husband to adopt them since the week he was getting married, mind you only having met him once for about 15 minutes. He has not seen or spoken to the children since 2020. Any advice is so appreciated. I live in California and in the process of registering our decree here from Texas.
