Aggressive Esa Dog Owner Refuses To Muzzle

Location: New York

I currently live in a mid size apartment complex on the same floor as a 60lb reactive pit mix. Every time this dog sees me or my dog it shows all signs of aggression. Pulled back ears, stiff tail, along with lunging and barking. This dog is way too close for comfort and I genuinely fear for the safety of me and my small pet.

I first brought this to the attention of my property management office several months ago, as not only is this dog extremely aggressive but its also on our breed restriction list. In true irresponsible reactive bully breed owner fashion, they have the dog registered as an ESA to bypass this. My intention was not for the dog to be completely removed, but properly restrained with a secure collar and muzzle. Months have gone by and even after several alerts from management she has done neither. After another close call this morning I got more evidence and reported it to management.

What are my options here? I know after multiple lease violations the eviction process begins but I’m not sure what the tenant’s current standing is or how long that would even take? I at the very least would like to be transferring to a similar unit on a different floor at least for some additional safety but I’m not sure if that’s anything I can demand. I am already taking steps on moving however the process for finding apartments in NYC this time of year can be timely and brutal due to low vacancy rates.
