[urgent Advice Needed] My Decline In Work Performance Is Attributable To Sexual Harassment I Have No Proof Of. I Was Put On A Pip, Facing Immediate Termination And May Lose A Lot Of Money Earned. Please Help!

In the last 12 months, I have worked with an employee (38M) who has verbally sexually harassed me nonstop, but I have no evidence of it. He was ridiculously smart about hiding it. It has resulted in a decline in my performance, in-office presence, and overall mental health.

On Wednesday, I was put on a Performance Improvement Plan with a 60 day turnaround. This PIP included allegations of poor performance on projects that I did not work on, therefore I do not want to sign the PIP as required. If I do not sign, it will result in termination from the firm. I tried to speak with HR to have the false allegations removed and come to an agreement on a document I could sign, but they will not allow me to speak up on my side.

The problem is, I am paid partly on a commission basis. I receive the second half of all commissions I earned in the last 12 months on 6/21 (just within the 60 day window). If I sign the PIP, the company is not obligated to pay me the second half of my commissions for performance reasons (almost a six figure commission).

My plan was to submit a 4 week notice on Monday morning and leave on a high note, fully understanding that I lost my commissions no matter what I do. Tonight I discovered a public document regarding the coworker who sexually harasses me. In May 2023, said coworker lost his CPA certification due to proven sexual harassment charges brought to CPA Ontario. The form is easily accessible on Google and is the second link when you search his name.

My question is, is there a way I can leverage this document in order to negotiate a letter of resignation with a 60 day notice where I can still get paid my commissions? I’m really afraid to speak up on this matter to HR as they have failed me in the past when I reported a similar situation. I do not want to file an HR case with no evidence and be terminated, and would rather leave on my own terms if possible.

Can I call my boss on Monday morning, direct him to a public record of an employee I work directly under, and mention that I hope he can sympathize with a situation I have been in for 12 months? Along with that, I could say I will willingly submit a letter of resignation with a 60 day notice, hoping we can negotiate the terms of my compensation with that? Will that work or will I be fired immediately?
