(uk) Do I Have To Work My Notice If My Employer Hasn't Paid Me Correctly?
Location: UK
Hello!
I've been with a company for a year and a half, and in my contract, it states that my "base pay" is £12.49 an hour. I was working at the base pay for a year and a bit, before being told that I would have extra responsibilities. If I did well with those extra responsibilities, I'd see a small pay increase.
Ive been meeting my work quota, and consistently outperforming colleagues that do the same work and get the increased pay, and asked for my pay increase. I was told that I wouldn't receive it, since they were "worried about my performance" and also said that I'd taken too many unpaid days off (roughly six since starting my new duties two months ago, due to personal reasons).
If I'm doing the work required of me, and doing well at that job, and not being paid, because I've had unpaid days off, do I have to work my full notice period, since they haven't kept their word on my pay increase? I'm doing extra work, unpaid.
Of course, it isn't in my contract, and isn't anywhere in writing, because this is my first job and I didn't think it would come back to bite me. I really thought that the company was looking after me, but lesson learned I guess.
My question is, in a short way, if I'm doing extra work and not being extra paid for it like I was told, can I simply leave? Or must I work my notice?
