We Own An Easement Behind Our Fence Which We Were Told We Cannot Legally Place The Fence Around. Our Neighbor Removed The Gate Access To The Easement And Replaced It With Fencing, And Is Acting Like It’s Theirs.

The neighbor recently passed away, and their children removed the gate and closed off the access to said easement without our knowledge.

We are getting the property surveyed this week and now do not have access to the easement.

After the survey, we intend on removing the fence and planting several trees on our property line as a fence replacement.

Do they have a legal right to our property which they are treating as their own? We currently have an older survey map of the property is ours and shows the gate entrance.

They have treated the easement like their property merely because we weren’t allowed to put a fence beyond it.

Now they have officially closed it off- on our property
