Traditional Gestational Carrier

TLDR: Have a married friend living in Louisiana who will have a traditional gestational surrogacy for me. I live in Michigan. Surrogacy is illegal in Louisiana (maybe?)... Can this be done??

----------------------

A very good friend of mine (lives in Louisiana) is married with a few kids of her and her husband's own. She very graciously had a child for us (gay couple living in Michigan) through artificial insemination and the legal process to adopt the child was a challenge, but not impossible. We did it and all went pretty smooth!

She offered to have another child for us now, but the artificial insemination process is no longer an option (multi reasons). We are exploring IVF and found a decent company to work with that has a location to which we can both travel. CNY Fertility. We had our initial meeting with them and the process sounded pretty simple, start to finish. We are waiting on just the time frame now, but I just got an email from them stating: "We will need a copy of your legal agreement FROM AN ATTORNEY prior to an embryo transfer."

Well, we don't have a legal agreement. Didn't need one the first time, not expecting to need one this time. BUT, especially since the state of Louisiana does not legally "allow" surrogacy outside of heterosexual married couples, I don't think we can actually get a legal agreement worked up. Any way around this? OR...????

Are we over thinking this? Does it matter about Louisiana because she lives there, but we're in Michigan. Do we only need to worry about Michigan law where we live, or New York law where we would be doing the IVF? OR, do we need to worry about Louisiana law (where the baby will be born), Michigan law (where the baby will be raised and adopted), and/or New York law (where IVF will take place)?

Thank you so much for any and all insight.
