Selling Agent Married To Seller

My fiancee and I just bought a house. We were very excited about it and when we went into settlement we got to meet the previous owner (plural, but at the time we didn’t know and I will get into that later) and she seemed very sweet and emotional about selling the house.

Flash forward to three months later we found a major external water leaking issue that was coming into the house that we believe the previous owner covered up/hid due to the fact that when we found it, it was hidden with duct tape and cardboard. We have gotten several contractors to look at it and all have said 100% the previous sellers hid that to a point where an inspector wouldn’t be able to find it easily. Also that the issue had been going on for a VERY long time. We reached out to our agent because it’s estimated at $5,000 worth of damage. After our agent discussed with his legal team they reviewed the document that she signed saying there were no latent defects with the house. We have photo, video, and now professional evidence to rebuttal that.

As my agents legal team did more digging, they found that the sellers agent was actually her husband (and he lived in the house!) and they did not disclose that legally (there was a box to check on the disclosure of licensee status that they did not check off). So not only did they lie about the latent defect but also about the relationship to the seller. Additionally, he was her representative and is a licensed real estate agent who sold the house through the company he works for.

To my understanding in the very early stages I’m at with all of this, there is some legal ground here for my fiance and I. I’m not asking for legal advice but moreso what I could potentially get out from all of this if I decide to take them to civil court? And if it’s worth it? Because at a minimum I want the previous OWNERS to pay for the water leaking issue since they did not disclose that.
