Public School Is Refusing Pt And Ot To A 3 Year Old Disabled Child With Stage 4 Cancer That Has Caused Temporary Paralysis Yet Is Accomodating The Same Programs To Non Disabled Children

So for backstory I live in the state of New York and I have a little sister who is 3 with stage four cancer and removal of one of her tumors has taken her ability to walk. My mother has been working with the school she would’ve been going to since she is the age for their early head start program , on getting her physical and occupational therapy to help her gain her ability to walk again before she has irreversible damage she cant come back from. The school has basically acted like they would be accommodating and has made my mother jump through all the hoops to try to help my sister. However recently they just told her she wouldn’t be able to get her in home pt and ot due to them having to drive “too far” (for reference my house is 20 minutes from the school but the school district covers my town due to it being the closest school to it). With finding out this information my mother also has talked to other parents the school helps with in home pt and ot and has recently found out that they drive 30-35 minutes in order to help a non disabled child with the same things they should be helping my sister with even though it’s further than our town is yet they claim our town is “too far” (another thing to note this is a public state of New York school not a religious institution etc.) I’m trying to build a case to present the school with however I need a slight amount of help on where to start does anyone have any knowledge or advice on something like this and do you think there is a genuine case ?
