Owner Is Charging Customers More Gratuity Than They Are Giving Us

Hi there,
Coworker saw an invoice they weren't meant to see. Did some digging and found a couple more. Basically, the owner of the company is charging customers 20% gratuity and a separate service fee, but we are not getting the full 20%.
When my coworker brought it up to the owner, they doubled down on it. Saying that "they have to get paid too." But charging $2000 just for grat and only giving the team $1000 for tip pool? What the hell?
My thing is even if they're only planning to give us like 1000 for grat, fine. But it should be invoiced that way. The customer thinks we're ballin out here but we're not.
I don't think this is legal. Do I have any recourse here? Located in Texas.
