Need Guidance Regarding An Assault On My Child

Card image cap

My child came home from school the other day after a child had been physically assaulting him at PE. The child assaulted him at 5 different points and each time he punched my son as hard as he could in the genitals. My son eventually threw an object at the child in an attempt to get him to stop and the child then proceeded to tell the teacher at which point they were informed they were both being punished.

My son came home and complained of pain in that area and explained what had happened. After showing my husband his impacted genitals we immediately knew he needed to be taken to the ER. The doctor in the ER was immediately taken aback and insisted that the injuries could only be the result of intentional malicious abuse.

Following this, it got around to my son that the child in question was at school jesting about my son and how he needs to toughen up. So we advised the police, after filing a report that we would like to press charges. My question is, do I have any legal grounds to sue the school or the negligent staff that were standing in relatively close proximity to where the events occurred but instead of performing their duties and supervising the children, whose they have been entrusted with, they stood around conversing and laughing amongst one another.

I know that public agencies and their employees have qualified immunity in a lot of circumstances. Do I have any options in the way of legal recourse and if so are their any law firms that operate in Florida that would be willing to take the case. None of the local attorneys I have spoken to handle these types of cases, despite concurring that there is grounds for a lawsuit.

Thank you so much, in advance, for all of your assistance.
