I Believe A Neighbor's Spillway From Their Pond Is Causing My House/garage To Flood.

Like the title says. Me and another neighbor live in a sort of valley that has a natural creek that runs through our property. Just north of us is a house at the top of the hill that has a man made pond. Every time it rains a good amount both our properties flood so bad that it's washing the foundation of my neighbors house away and it's ruining our garage and basement. I used Google earth to look and find the pond and noticed their spillway points in the direction of the valley that funnels into the creek. How do I prove they are the cause or what do I need to do because at least once a year I'm shoveling mud from my garage and my neighbor is having to have dirt hauled in to protect her home.
